1. General
1.1 These Terms and Conditions (T&C) govern the contractual relationship between TomFit AG and its members, in particular with regard to the use of locations operated by group companies or third parties, and membership rights. In addition, the Terms of Service (ToS) apply to all digital services such as the TomConnect App and the website www.tom.fit.
1.2 By concluding a membership agreement, the member accepts these T&C, which form part of the contract.
1.3 The use of TomFit’s locations and services is exclusively reserved for members who have concluded a valid contract.
2. Membership
2.1 Membership Models:
TomFit offers the following standardized membership models:

Members can independently book their training capacity via the TomConnect App. Unused training capacities expire at the end of the respective calendar week. For Essential membership, an enrollment fee of CHF 100 is charged.
2.1.1 Additional Bookings:
Beyond the training capacity, the member may book additional time on the machine at CHF 10 per 20-minute unit.
2.1.2 Coaching: TomFit recommends that customers regularly book a 1:1 coaching session for a 20-minute slot. This costs CHF 50. It ensures that the customer selects and performs the correct exercises optimally. The costs will be invoiced by TomFit or charged to the stored payment method.
2.2 Contract Duration & Renewal:
The contract term is 12 months and is automatically extended by another 12 months unless terminated in due time and form according to section 5 of these T&C. Members will be informed in advance of the upcoming renewal.
2.3 Use, Booking & Expiry:
Members may flexibly book their training capacity within the respective calendar week. Unused training capacities expire at the end of the calendar week.
Members of the Advanced and Premium models receive access to all officially listed TomFit hubs in the region, subject to capacity.
Members of the Premium model receive access to all officially listed TomFit hubs nationwide, subject to capacity.
Booking is carried out centrally via the TomConnect App. Immediate studio changes are possible.
2.4 Booking & Cancellation Deadlines:
Cancellations are free of charge up to 6 hours before the start. Later cancellations are not possible, and the unused training capacity for the corresponding week expires.
2.5 Partner Training & New Customer Incentives:
In partner training sessions, the used training capacity is charged 50% to each partner. New customers may participate in a partner training session free of charge once. If the new customer signs a contract within 30 days, the inviting member will receive a 1-month credit (1/12) of the new member’s contract.
3. Use of Locations
3.1 General Use:
Members are entitled to use TomFit’s locations and/or those of its group companies or third parties within the scope of their membership during published opening hours. Access to the locations is exclusively via the TomConnect App. No physical access card is issued.
3.2 Compliance with House Rules:
Every member is obliged to comply with the applicable house rules. Violations may result in warnings, claims for damages, or termination of membership.
3.3 Hygiene & Conduct:
Members must always clean the equipment after use. Clean shoes or training in socks are mandatory.
3.4 Video Surveillance:
All locations are under video surveillance for security reasons. The recordings serve exclusively for fraud prevention and to guarantee the safety of members. They are not passed on to third parties unless required by law. Further details are regulated in the privacy policy.
4. Payment Terms
4.1 Due Date & Default:
Payments are due monthly or annually in advance. If a due payment is not made within 20 days after the due date, TomFit reserves the right to block access to training offers until full payment is received. The contract term remains unaffected.
4.2 Reminder Fees & Collection:
In the event of default, the first reminder is sent free of charge by email. From the second reminder onwards, a processing fee of CHF 20.– will be charged. In addition, default interest of 5% per year will be charged in accordance with Art. 104 CO. If the third reminder remains unsuccessful, TomFit reserves the right to hand over the claim to a debt collection agency and/or to terminate the membership contract without notice.
5. Termination & Dissolution of Contract
5.1 Ordinary Termination:
The contract has a term of 12 months and is automatically renewed for another 12 months unless terminated at least 30 days before the end of the contract. Termination can be made via the TomConnect App or in writing by email/post.
5.2 Extraordinary Termination:
Possible in case of illness, accident, or relocation to a place without a TomFit location (more than 30 km away). A medical certificate or registration certificate from the municipality of residence is required. In this case, the unused remaining term will be refunded on a pro-rata basis. Temporary suspension of membership is not possible.
6. FitPoint Program
6.1 Collecting & Redeeming FitPoints:
Members can collect FitPoints through certain activities (rewards) or promotions. FitPoints can be used exclusively at TomFit for selected rewards, services, or products. Redemption with third parties is excluded. TomFit is the issuing entity of FitPoints at each location. Cash payment or transfer to third parties is excluded. FitPoints are valid for 12 months from the date of credit or up to three months after the expiration of the membership contract. Unredeemed FitPoints expire after this period. TomFit reserves the right to change or discontinue promotions and rewards at any time. There is no retroactive claim for already expired or unclaimed rewards/promotions.
7. Sponsorship & Third-Party Funding
7.1 Sponsorship Accounts:
Companies or individuals can set up sponsorship accounts via TomConnect to financially support members. Upon termination of the sponsorship, a cash refund to the sponsor is possible. Already used sponsor funds cannot be refunded.
7.2 Sponsorship Models:
Sponsors can grant members performance-based credits.
7.3 Credit & Use:
Sponsorship funds are credited monthly as FitPoints and can only be used for membership fees, additional options, or purchases at TomFit. Redemption with third parties is excluded. TomFit is the issuing entity of FitPoints at each location. Cash payment or transfer to third parties is excluded.
7.4 Termination & Expiry:
Unused sponsorship funds expire after the end of the membership unless the sponsor has made a different agreement with TomFit. Sponsors may end their support at any time, but cannot retroactively revoke benefits already granted.
8. Sanctions & Misuse
8.1 Unauthorized Use of Member Profiles
The use of another person’s profile is strictly prohibited.
In the event of a violation, a fine will be imposed in accordance with the fee schedule, and TomFit reserves the right to terminate the membership without notice.
9. Liability
Any liability of TomFit and its group companies is excluded. The use of TomBot training equipment is at the user’s own risk.

10.1 Contact
If members have questions about these T&C or their membership, they may contact TomFit via the TomFit Member Service or the feedback form in the TomConnect App.
11. Final Provisions
11.1 Applicable Law:
Exclusively substantive Swiss law applies.
11.2 Place of Jurisdiction:
The place of performance and jurisdiction for disputes is the registered office of TomFit.
11.3 Severability Clause:
If any provision of these T&C is invalid, the remainder of the T&C shall remain unaffected.
11.4 Reservation of Changes:
TomFit may amend these T&C at any time. The T&C published in the TomConnect App or on the TomFit website apply. Members will be informed of changes in advance.
These T&C enter into force on 06.08.2025.
